Sri Lankan student to sue Australia after terror charges were dropped

The lawyer of a prominent Sri Lankan student who was accused of plotting to assassinate Australian politicians said he will sue police after prosecutors dropped terrorism charges on Friday.

Mohamed Kamer Nizamdeen, 25, was arrested in August and accused of writing in a notebook plans to kill then-prime minister Malcolm Turnbull and then-foreign minister Julie Bishop.

Police also alleged the PhD student possessed plans to make a “lone wolf” attack on several public places, including the Sydney Opera House, and he appeared to have links to Islamic State of Iraq and the Levant (ISIL).

Nizamdeen, a respected business student at the University of New South Wales, spent four weeks in jail after being charged with making documents to facilitate terrorist acts.

He was kept in solitary confinement in a maximum-security prison along with convicted murderers.

Prosecutors withdrew the charges in Sydney’s Central Local Court on Friday. He had been released on bail in September after police admitted an expert concluded it could not be proved the plot was in his handwriting.

Nizamdeen’s lawyer, Moustafa Keir, told reporters outside court his client would apply for legal costs and sue police.

“What authorities have done to this young man is absolutely unforgivable,” Kheir said.

“We will be seeking justice for him in the NSW Supreme Court. It’s a terrible experience, as a young man who has done everything right in life, he has gone through supermax jail in unforgivable circumstances.”

After Nizamdeen’s arrest, family members and hundreds of supporters in Sri Lanka held protests urging a swift and fair investigation.

Nizamdeen comes from a prominent Sri Lankan family. His uncle Faiszer Musthapha, the country’s sports minister, insisted his nephew was innocent.

    Dear Prime Minister,

    Re: the final call to address the government’s injustice.

    As a writer, I have been facing enormous setbacks in Australia. The Australian Government deleted my citizenship and traumatised me by declaring me an illegal immigrant when I was made aware of the Aboriginal people’s and refugees’ deprivation. My house (37 Bradman Drive, Sunbury, Victoria 3429) was searched by fifteen Victoria Police members under a false accusation. I would like to know how the police obtained the search warrant, and under what circumstance? I urge you to disclose the information to the Australian public. The Australian Government stopped me from holding onto my job or getting a job, by propaganda; it even stopped me from selling my house, which forced me to file for bankruptcy. When I had an open house for inspection for potential buyers, the police would come for questions. The police deliberately created fear among the people so I would not make a profit from the house, so now I cannot afford a lawyer to sue the government. As far as I know, I am the only person who has sold a house for loss in Australia.
    My passport disappeared from my house. When I applied for a new passport I was told that I was an illegal immigrant. Obviously, the government stole my passport during the house search and deleted my citizenship details in the database due to my writings. Nobody could help me, including human rights lawyers, because of the government’s ability to manipulate the Australian people. My citizenship certificate (No: ME9701311V, issued on 26/03/1997) has disappeared from the system; still, the Australian government hasn’t given a reason. I wrote to the United Nations, and also to the international community about the government’s cruel action. Due to international pressure, the government quietly reinstated my citizenship, without an apology. Ten years have gone by; still, I cannot find a lawyer to seek justice. Worst of all, the government has started to attack my health quietly, to get rid of myself, to cover its wrongdoings. One lie leads to many lies; likewise, one foolish action leads to many foolish actions. Basically, the government is at a loss when it comes to dealing with me.
    For the last ten years I have been raising awareness across the world of the Australian Government’s cruel action. It makes one wonder what the Australian Government would do for enlightening others about its undemocratic actions. I returned to Australia at the end of last year. Since landing in Australia, I was isolated and my health has been targeted. I lived in Australia between 1991 and 2006. Since I landed in Australia last year I volunteered to help to provide meals for homeless people in Melbourne. I always help people and have made many good friends. However, since landed in Australia last year nobody wants to associate with me, including my uncle and cousins. This is clearly isolation; the Australian Government wanted to achieve something radical, so it has isolated me from my relatives and friends through its propaganda. Last year I was forced to say in a youth hostel in Melbourne. I believe that members of the Australian intelligence service mixed something with my food while I kept my food in the common fridge at the youth hostel.
    Within a few days of landing in Australia, I was admitted to a hospital. A few months later I broke my right arm through a low impact injury, due to osteopenia. Between 2008 and 2017 I had lived a healthy life in many places around the world, and I did not need to see a doctor. However, since returning to Australia, my health has been affected. When the Australian government deleted my citizenship, I reached out for help from the international community, and this forced the Australian Government to reinstate my citizenship. As soon as my citizenship was reinstated I applied for a passport and left the country; because, I did not want to take a chance. Between 2008 and 2017 I lived a healthy life in Canada, Germany, New Zealand, Singapore, Malaysia and Sri Lanka. I did not need to see a doctor for any health issue whatsoever. Those countries’ representatives will testify that my statements are true and correct.
    Since last April I have consulted three doctors in Australia, and they all have confirmed that I would not have lost vitamin D so quickly, unless something unusual had happened to my body. Notably, before arriving in Australia I spent two years in the north of Sri Lanka and soaked up plenty of sunlight, while I was enjoying gardening at my parents’ house. It is very obvious to me that the Australian intelligence network has been targeting my health. According to my experience as a writer, one thing is very clear to me; the West’s primary focus is to keep its dominant power. Anything else is secondary, including human development. Otherwise, the Australian government would not have deleted my citizenship for raising awareness of the Aboriginal people’s deprivation, or attack my health for enlightening others.
    Among my family members and relatives, I am the only one who has completed a business degree, yet I am financially worse off than others. The Australian Government has been insulting the value of education and knowledge by keeping me poor; this is the hardest part for me to forgive. I urge you to stop underestimating my capacity. If you really understood my credentials, you would not do what you have been doing for the last ten years. Currently, I am undertaking postgraduate studies in Australia in the field of human resources management. I have completed a business degree program at RMIT University, Melbourne. I have travelled to more than 25 countries to gain an understanding of histories, cultures and political systems. I have read more than three hundred books to understand world history, cultures, languages, communism, capitalism, human development, global economics and international affairs. As a committed Christian you must make a provision for the Australian public to know the truth, issue a public apology, and provide financial compensation to carry on my life in Australia. Do not take my final request lightly.
