UN women’s rights experts want foreign judges in Lankan probe

The UN Committee on the Elimination of Discrimination against Women has called on Sri Lanka to ensure international participation in the accountability mechanisms as a necessary guarantee for the independence and impartiality of the process.

In a report on Sri Lanka issued today, the UN Committee on the Elimination of Discrimination against Women has also called on Sri Lanka to ensure international judges, prosecutors, investigators and lawyers participate in the accountability mechanisms in line with Human Rights Council resolution 30/1.

The UN Committee has also called on Sri Lanka to expedite the review and amendment of the Assistance to and Protection of Victims of Crimes and Witnesses Act, to incorporate better safeguards for the independence and effectiveness of the judiciary and witness protection programmes, in line with international standards.

It also is concerned about the ongoing militarization of large areas of private land in the conflict-affected areas of the country, the usurpation of civilian administration responsibilities by the military, and the resulting large scale displacements of women and men in the State party, where 32 camps for internally displaced persons continue to exist.

It is particularly concerned that such militarization constitutes a barrier to the resettlement of internally displaced women, durable solutions for their housing, and their ability regain their livelihoods.

The Committee also notes that a Cabinet Sub-Committee was appointed in 2016 to amend the Muslim Marriage and Divorce Act.

However, it notes that the Committee appointed by the Minister of Justice in 2009 to consider and propose reforms to Muslim Personal law and the Quazi courts has not issued any recommendations.

The Committee reiterates its previous concerns and, given that the Muslim Marriage and Divorce Act imposes exclusive and compulsory jurisdiction over Muslim marriages, the Committee expresses its particular concern that it does not specify a minimum age of marriage and girls under 12 years of age are permitted to marry; restricts the legal and judicial officer positions of Quazis, Board of Quazi members, Marriage Registrars and adjudicators to male Muslims only; and that the law on statutory rape is not applicable to girls under 16 years of age who are legally married under Muslim law, who engage in sexual intercourse with their husband while not legally separated.   1. MORALITY BECOMES A WEAPON TO THE WESTERNERS

    The Western Countries are the masters at occupying the high ground, and translating it into great power. In their hands morality becomes a weapon, they wield to attract attention to their cause while distracting attention to others. They make such a show of moral superiority that the others feel ashamed to disagree with them. The Western Countries have killed millions of innocent people, yet they present themselves as moral superiors. In fact, the British knew the meaning of democracy and human rights from the 12th century, but they never practised it while killing millions of innocent people to takeover others’ homelands and resources. They are free to do whatever they want, by waving their magic cards so called “democracy and human rights”. In fact, the Americans, Australians, Canadians and Kiwis do not even live in their own country. If that is the reality then how can they talk more about democracy than others?

    The Spanish took part of South America, the Dutch and Portuguese took part of South America and Asia, the French took Africa, and the British took most parts of the world. Millions of innocent people were killed by the Westerners. More than a hundred million indigenous people were killed in Australasia and North America. Twenty two million Africans were killed during the slave trade. Fifty nine million Indians were killed by starvation while the British rulers were sending India’s food to the United Kingdom and Europe. Furthermore, more than one million people were killed in Vietnam, Afghanistan and Iraq. But no-one was held accountable for those innocent people’s deaths. However, the British and the Americans kept the records of Nazi Germans’ atrocities in detail, and exposing them to the world, in order to cover-up their own atrocities. The Western Countries will never admit their atrocities; if they do then they can’t keep themselves on top. The Western countries are extremely clever in disguising their ulterior motives and dirty tricks.

    • What are you trying to say? Crimes committed decades and centuries ago justifies any crimes that happens now?

      Or are you saying West committed crimes in the past now Asia “Sri Lanka” should get a free pass to commit crimes against its own people.
