US envoy to Geneva insists Lanka needs foreign judges

AmbHarperUSUPR-380x280The US Ambassador to the UN Human Rights Council in Geneva, Keith Harper, says Sri Lanka must have foreign judges in the accountability process on the war.

Harper, who was involved in talks with the Sri Lankan Government when the resolution on Sri Lanka was drafted before it was submitted and eventually adopted by the UN Human Rights Council last October, said that the accountability process can be credible only if foreign judges are involved.

“For #SriLanka – credibility of any accountability mechanism requires involvement of foreign judges etc.  That has and will not change,” he tweeted.

When presenting the resolution on Sri Lanka to the UN Human Rights Council last October Harper had said that the resolution seeks to support Sri Lanka’s path to lasting peace, built on a foundation of justice and accountability. (Colombo Gazette)

  1. Sri Lanka’s judiciary was established in April 1801 by Royal Charter, and has a long and proud history with distinguished judges sitting on the bench. Today, the Chief Justice is a member of the Tamil community, and is more than capable of dealing with any matters relating to transgression of the law. Sri Lanka is a sovereign country and has the intrinsic right to decide for herself without imposition of foreign views and judges from outside the country. If wrongs have been committed in the military action taken against the internationally designated Tamil terrorists that thrust a war on the country, it is nothing unusual for Sri Lanka’s experienced judges and lawyers to deal with. Even the funding of the Tamil terrorists by the pro-Tamil Tiger expatriate organizations too should be reviewed by the courts, as these funds and material support was utilized by the Tamil Tigers to abduct underage children and conscript them for warfare which is a war crime, and even train some to become suicide bombers.
    Not only the courts but also Sri Lanka’s military courts have taken offending soldiers to task and meted out punishment. Leave Sri Lanka to handle her affairs like any other sovereign country.

    You made a big mistake of buying into the lies of SL govt. at the time of resolution. They have committed war crimes it is proven and obvious, they don’t want to be investigated, the current president was defence sec. when war crimes took place, do you think he will put himself in trouble? you guys made the mistake of being soft on them,, any SL govt. will do the same, they will lie, they are not civilized people. If you give into this now, in 3 months time they will say there was never a war in the country. etc.
    you have been fooled several times before, this is one more time, what do you want to do now?

  3. Please note that Sri Lanka is an independent country and not part of the USA. As such it is surprising what right Mr Harper has got to insist an indendent nation to do anything against their will. Does the USA change it’s policies on the insistence by other nations.

    As an independent nation Sri Lanka should have a right to change it’s position as deemed necessary by its government.

  4. Does this idiot not trust or accept our ability to conduct an impartial inquiry.
    if he does not trust us how can we trust him to make a true case or these foreigners. they may have their own agendas. we have seen such on numerous occasions like that norwegian who happens to be a SL basher at every opportunity.
    how come none of these people called inquiries into the iraq and afgan conflicts involving the HR crusader the US aided by UK. now it appears that some of the UK and more than likely the US troops commited war crimes in those conflicts.
    how is it that this harper chap is not clamouring for any inquiries into those. is he in their pockets or what.

  6. THIS IS IDIOTIC AND UTTER STUPIDITY BY THE US ENVOY,TO HAVE ALLED FOR FOREIGN JUDGES FOR OUR INETERNAL ADJUDICATIONS, TO PERFORM WHICH THERE ARE ADEQUATE SRI LANKAN
    JUDGES ( WHEN NOT CAJOLED BY THE GOVT.) EQUAL AND IN PAR WITH ANY INTERNATIONAL ADJUDICATORS. IT IS A CONDEMNABLE ACT ON PART OF FOREIGN SPOKESMEN TO ALWAYS VIEW SRI LANKANS WITH A SENSE OF PREJUDICE.WE CONDEMN THEM AS UNFRIENDLY BASTARDS.

I forgot another important factor, that if independant judges are not appointed severe economic sanctions should be be applied together with GSP also added to the list.This is a serious human rights issue that cannot be compromised. The Govts since independance have trampled on the rights of the citizens with utter disregard and impunity.

Though the govt changed nothing else has.It is imperative that independant judges cannot be found in Srilanka and the whole judiciary has been politicised by Mahendra R.Where on earth have one heard of rape and assault by a supreme court judge like the case of Sarath De Abrew.The Inside trading racket individual Raj Rajaratnam when he was questioned how fair his 10 year sentence was ,said it was fair and said that if he was in Srilanka he would have bribed the judge for 50000/ rupees and have the judge same night for dinner. This speaks volumes on the integrity of the judiciary.

  9. Since we have qualified and capable judges here, I do not think we require any foreign judges.. The problem was we have delayed in sending this report all this time.
